Litigation crossfire: From player claims to brand protection, how is litigation shaping the industry?
Licensed operators are increasingly finding themselves caught in the crossfire of legal proceedings brought before consumer-friendly courts for alleged licence infringements, as well as facing aggressive competition from illegal operators. In recent years, jurisdictions around the world have seen a sharp increase in legal action taken by players to enforce their rights, including so-called ‘player claims’. While some industry advisors had expected the Court of Justice of the EU to provide clarity in pending referrals for preliminary rulings, an Attorney General’s hardline anti-gambling stance — which has even likened online gambling products to selling drugs — has dimmed hopes for legal relief. Have regulators allowed courts to usurp their oversight, and should the industry be more proactive in interacting with customers to promote responsible gaming and mitigate the risk of litigation? At the same time, licensed operators are finding that their markets, products and brands are being infringed upon by illegal operators and advertising. In countries that restrict or ban gambling advertising outright, licensed operators may find themselves at a disadvantage and struggle to compete. Tech giants are reluctant to act against brand infringement on their social media platforms. Is legal action against illegal operators or brand infringement an effective way of protecting licensed operations?
